KATHRYN HONECKER'S practice focuses on class actions in federal and state courts throughout the United States, representing plaintiff classes in major consumer fraud, civil rights, employment and insurance sales practices cases and other complex commercial litigation. Ms. Honecker is admitted to practice law in the state courts of Arizona and Illinois, as well as the United States District Courts for the District of Arizona, the Northern District of Illinois, the District of Colorado, and the United States Court of Appeals for the Tenth Circuit.
Ms. Honecker, along with Mr. Balint and Mr. Fairbourn, recently served as co-counsel for the Lead Plaintiffs, the Policemen’s Annuity and Benefit Fund of Chicago, and a class of shareholders seeking relief under Section 10(b) of the Securities Exchange Act of 1934 and Rule 10b-5. In re Apollo Group, Inc., CV-04-2147-PHX-JAT (D. Ariz.), was one of only six such cases to have gone to trial since the passage of the Private Securities Litigation Reform Act (PSLRA) in 1995. Following a nearly two month jury trial, Lead Plaintiff successfully obtained a verdict against the Defendants of approximately $275 million – one of the largest verdicts for an investor class since the PSLRA was enacted.
Ms. Honecker has also represented minority policyholders in several class actions against various insurance companies under the Federal Civil Rights Act for racial discrimination in the sale and administration of life insurance policies and for discriminatory credit scoring in the sale and administration of property insurance policies. She has also served as counsel or co-counsel in numerous consumer fraud and anti-trust class actions, and represented employees in collective actions filed under the Fair Labor Standards Act.
Ms. Honecker is a member of the Arizona Women Lawyers Association, the State Bar of Arizona, the Illinois State Bar Association, the Maricopa County Bar Association, the American Bar Association, and the American Association for Justice (formerly ATLA), and currently is co-editor of the American Bar Association’s Class Action and Derivative Suits Newsletter.
Ms. Honecker received her Bachelor of Arts degree, cum laude, from Carthage College in 1995, and her law degree from Creighton University School of Law in 1998, also graduating cum laude. During law school, Ms. Honecker served as a legal writing tutor for other law students, as a research assistant and editor for three professors, and as an intern at both the Douglas County Attorney’s Office and the U.S. Attorney’s Office.
Prior to joining Bonnett, Fairbourn, Friedman & Balint, P.C., in 2000, Ms. Honecker was an associate with the law firm of Holmstrom & Kennedy, P.C., in Rockford, Illinois, where she practiced in the areas of civil and commercial litigation, estate planning, and medical malpractice defense. While in Illinois, she also served as an Arbitrator for the Circuit Court of the 17th Judicial Circuit of Illinois and as Antitrust Counsel for the Association of Women in the Metals Industry.
